Frequently asked questions
WHAT IS CONVEYANCING?
Conveyancing is the legal process of transferring ownership of a property from one person to another. This involves a series of tasks such as conducting searches, preparing and reviewing contracts, and handling the exchange of funds.
As solicitors, we can assist in all aspects of the conveyancing process, ensuring that the transaction is carried out smoothly and in accordance with all legal requirements. We can provide expert advice on any potential issues that may arise, such as boundary disputes or restrictive covenants, and work to resolve them effectively.
Our goal is to protect our clients' interests and provide them with peace of mind throughout the conveyancing process. Whether you are buying or selling a property, our team of experienced solicitors is here to guide you through every step of the way.
WHAT ARE CONVEYANCING FEES?
Conveyancing fees are the costs associated with the legal and administrative work involved in transferring the ownership of a property from one person to another. These fees typically cover services such as property searches, land registry fees, and legal documentation. The exact amount of conveyancing fees can vary depending on the complexity of the property transaction and the location of the property.
As a guide, our basic fees can be found here by clicking this link.
It is important to understand that conveyancing fees are separate from other costs such as stamp duty, survey fees, and mortgage arrangement fees. It's advisable to obtain a detailed quote from a conveyancing solicitor or licensed conveyancer before proceeding with any property transaction to ensure that you are aware of all the associated costs.
HOW LONG DOES CONVEYANCING TAKE?
The conveyancing process in the UK can vary in length depending on several factors. On average, it takes between 8-12 weeks to complete, but this timeline can be affected by the complexity of the transaction, the responsiveness of all parties involved, and any unforeseen legal issues that may arise.
The process typically involves several key stages, including property searches, surveys, agreement of terms, exchange of contracts, and completion. It's important to work with a reliable and efficient conveyancer who can help navigate the process smoothly and keep you informed of any delays or issues that may arise. While it's impossible to guarantee an exact timeline, being proactive and organized can help expedite the process and ensure a successful outcome.
DO I NEED A SURVEY?
A survey is not always mandatory for conveyancing in the UK, but it is highly recommended and mostly a condition for most mortgage providers.
A survey can provide valuable information about the condition of the property, highlight any potential issues, and potentially save you from costly repairs in the future. It can also give you bargaining power when negotiating the purchase price. There are different types of surveys available, such as a homebuyer's report or a full structural survey, and the type you need may depend on the age and condition of the property.
Ultimately, getting a survey done can provide peace of mind and help you make an informed decision when buying a property. Therefore, while it may not be a legal requirement, it is a wise investment to consider getting a survey done during the conveyancing process.
HOW ARE CONTRACTS EXCHANGED?
In the UK, contracts for the conveyance of a property are exchanged through a process known as "exchange of contracts." This typically occurs after the buyer and seller have agreed on the terms of the sale and their solicitors or conveyancers have finalised all necessary legal and financial details.
During the exchange, the signed contracts are physically swapped between the buyer's and seller's legal representatives, and the buyer will usually pay a deposit to secure the property.
Once the contracts are exchanged, both parties are legally bound to complete the transaction. It is important to note that until the exchange of contracts has taken place, either party can still withdraw from the sale without legal repercussions. This exchange of contracts is a crucial step in the property conveyancing process and marks the point at which the sale becomes legally binding.
